What is Provisional Acceptance?

Provisional Acceptance primarily means that the work is completed and you have taken possession of the property. This allows the company to claim the balance of the price and marks the beginning of the period during which you can carry out a thorough inspection of the completed work.

What should you pay attention to during provisional acceptance?

  • Check the conditions of your contract: Most contracts state that the project owner "approves" the work at provisional acceptance. In other words, you consider that the work has been properly carried out and you release the company from responsibility for visible defects.

  • Report defects in an acceptance report: If you notice visible defects, poor workmanship, or shortcomings, mention them in a provisional acceptance report. This must be signed by you and the company. If the defects are minor, you can accept the acceptance with reservations, and the company must correct them. In case of major defects, provisional acceptance should be postponed as long as the problem persists.

  • Check compliance with the Breyne Law: Has the company complied with the provisions of the Breyne Law? If you wish to cancel the contract, this must be done before provisional acceptance (before signing the authentic deed in the case of a sale).
